Terms of Service

Welcome to WAbulk. These Terms of Service ("Terms") govern your access to and use of the WAbulk Chrome Extension and related services (collectively, the "Service") provided by WAbulk ("we," "us," or "our"). By installing, accessing, or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the WAbulk Chrome Extension, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

WAbulk is a Chrome Extension that enables users to send personalized bulk messages through WhatsApp Web. The Service is designed to help users communicate efficiently while maintaining a personal, one-to-one message experience.

3. Privacy and Data

  • The extension runs entirely in your browser on WhatsApp Web.
  • We do not sell personal data.
  • We don't store message content on our servers.

4. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

5. Account and Access

  • You are responsible for maintaining the security of your browser and any devices used to access the Service.
  • You agree not to share your access to the Service with unauthorized parties.
  • You are solely responsible for all activities that occur through your use of the Service.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for sending spam, unsolicited messages, or any form of harassment.
  • Violate WhatsApp's Terms of Service or any applicable laws and regulations.

WAbulk operates as an overlay on WhatsApp Web. You acknowledge and agree that:

  • You must comply with WhatsApp's Terms of Service at all times.
  • WhatsApp may have policies against bulk messaging that could result in account restrictions or bans.
  • We are not responsible for any actions WhatsApp takes against your account.
  • WAbulk is not affiliated with, endorsed by, or sponsored by WhatsApp or Meta.

To stay compliant, you must:

  • Not scrape or harvest phone numbers from any source.
  • Only message opted-in or expected contacts who have a prior relationship with you.
  • Avoid misleading, deceptive, or spammy marketing practices.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by WAbulk and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

9. Subscription and Payments

  • WAbulk offers both free and premium subscription plans.
  • Premium features require a paid subscription.
  • All fees are non-refundable unless otherwise stated or required by law.
  • We reserve the right to modify pricing with reasonable notice to existing subscribers.
  • Subscriptions may auto-renew unless cancelled before the renewal date.

10. Free Trial

We may offer free trials of premium features. At the end of the trial period, your subscription may convert to a paid subscription unless you cancel before the trial ends.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the Service will be accurate or reliable.
  • The Service will meet your specific requirements.
  • Any errors in the Service will be corrected.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WABULK, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Any actions taken by WhatsApp against your account.

14. Indemnification

You agree to defend, indemnify, and hold harmless WAbulk and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WAbulk operates, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WAbulk regarding the Service and supersede all prior agreements and understandings.

20. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
